Rules for using our website and Apex Command.

Legal review note: These terms are a practical launch draft based on the current Apex offer and product behavior. They should be reviewed by qualified counsel before Apex scales beyond an initial pilot.
1. Website and walkthrough requests
You may use the public website to learn about Apex Leads Inc. and request a walkthrough. A walkthrough request does not create a paid subscription, guarantee acceptance as a client, reserve a start date, or authorize Apex to contact your customers.
2. Service scope
Apex Command is a contractor lead-operations workspace for records such as leads, contacts, conversations, appointments, estimates, jobs, tasks, and reporting. The exact services Apex configures or performs for a client are controlled by the written scope or service agreement accepted by that client.
Unless a written scope expressly says otherwise, the standard offer does not include guaranteed leads, jobs, revenue, advertising performance, automatic phone answering, customer SMS, or an autonomous AI receptionist.
3. Accounts and authorized use
Workspace access is for authorized users of the business assigned to that workspace. You are responsible for keeping login credentials secure, using accurate account information, and promptly reporting suspected unauthorized access. Do not attempt to access another business's workspace, bypass access controls, probe for private data, or interfere with the service.
4. Customer information and communications
Clients are responsible for having an appropriate business purpose and any legally required permission to collect customer information or contact customers. Drafts, reminders, or suggested messages must be reviewed for accuracy and consent before use unless a separately tested and approved automation is explicitly enabled.
Do not use Apex Command to send unlawful, deceptive, abusive, harassing, or unsolicited communications, or to store passwords, payment-card data, government identifiers, or other highly sensitive information that the service is not designed to hold.
5. Records and reporting
Reports and dashboard figures reflect records saved in the workspace. They are operational information, not audited financial statements and not a promise of business results. Clients remain responsible for verifying estimates, pricing, appointments, job status, customer communications, and other real-world outcomes.
6. Fees, billing, cancellation, and custom work
Public pricing describes the current standard offer. The applicable setup fee, recurring fee, billing date, taxes, support scope, custom work, cancellation terms, refunds, and offboarding terms must be stated in the client's written scope or payment agreement before payment. If that written agreement conflicts with this page, the written agreement controls for that client.
7. Third-party services
Apex relies on third-party infrastructure and providers, which may include hosting, authentication, database, email, telecommunications, and payment services. Their outages, restrictions, or policy changes can affect availability. Apex may change providers or technical components as the service evolves.
8. Availability and changes
We work to keep the service available and accurate, but we do not promise uninterrupted or error-free operation. Features may be improved, paused, replaced, or removed when needed for security, reliability, provider requirements, or product changes. Material changes affecting a paid client's agreed scope should be handled through that client's service arrangement.
9. Intellectual property
Apex retains its rights in the website, Apex Command, branding, software, documentation, and service materials. Clients retain rights in their own business information and customer records, subject to the permissions needed for Apex and its service providers to operate the service.
10. No guarantee of business results
Apex provides software and agreed operational support. Results depend on factors outside Apex's control, including lead quality, market conditions, pricing, sales execution, staffing, customer decisions, and the completeness of data entered by the client. No specific volume of leads, appointments, jobs, revenue, savings, or return on investment is guaranteed.
11. Suspension and termination
Access may be suspended when reasonably necessary to address security, abuse, nonpayment under an applicable agreement, unlawful use, or a material threat to the service or other users. Client-specific cancellation, data access, retention, and offboarding terms are governed by the written service agreement or scope.
